TERMS AND CONDITIONS OF USE AND SALE

Welcome to MotionCodeMX. These Terms and Conditions govern the purchase, download, and use of the WordPress plugin named "Woo Custom Clients" (hereinafter, the "Software" or "Plugin"), developed and marketed under the trademark MotionCodeMX (hereinafter, "We", "The Provider", or "MotionCodeMX").

By purchasing, downloading, installing, or using the Software, you (hereinafter, the "User" or "Customer") agree to be legally bound by these Terms and Conditions.

1. Product Nature and License of Use

Woo Custom Clients is a downloadable digital product. Upon purchase, the Customer does not acquire ownership of the source code, but rather a limited, non-exclusive, and non-transferable license to install and use the Plugin on the number of websites specified in the purchased plan (e.g., Standard License for 5 sites, PRO License for 100 sites).

2. Refund and Return Policy (Strict)

Due to the digital, intangible, and easily reproducible nature of the Software, WE DO NOT OFFER REFUNDS OR RETURNS under any circumstances once the payment has been processed and the download link or license key has been delivered.

  • By making a purchase, the Customer acknowledges and agrees that they waive any right of withdrawal or refund.

  • It is the Customer's sole responsibility to read the product description, review the required compatibility (WordPress and WooCommerce versions), and ensure that the Plugin meets their needs before making the purchase.

3. Disclaimer of Liability and Backup Obligation

The Software is provided "as is", without warranties of any kind, express or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose.

  • Backup Obligation: The Customer understands and accepts that it is their absolute and exclusive obligation to perform a full backup of their website (files and database) BEFORE installing, updating, or configuring the Plugin.

  • Zero Liability for Damages: In no event shall MotionCodeMX be liable for any direct, indirect, incidental, special, or consequential damages (including, without limitation, loss of data, loss of revenue, server downtime, conflicts with other plugins or themes, or business interruption) resulting from the use or inability to use the Plugin. The Customer installs and uses the Software at their own risk.

4. Technical Support and Updates

The purchase of a license includes access to technical support and Software updates for a period of 1 (one) calendar year from the date of purchase.

  • Support is strictly limited to issues directly related to Software bugs or questions regarding its native configuration.

  • We do not provide support for conflicts caused by third-party software, code customizations, or general server and WordPress configuration issues.

5. Right to Modify or Discontinue Service

MotionCodeMX reserves the right to modify, suspend, or discontinue (temporarily or permanently) the development, support, updates, or sale of the Software at any time, with or without prior notice.

  • If the product is permanently discontinued, active licenses will continue to function in their current state, but no refunds will be issued, nor will future updates or technical support be provided from the date of project termination.

  • We reserve the right to modify the prices of our products or subscriptions at any time.

6. Jurisdiction and Governing Laws

These Terms and Conditions are governed by and construed in accordance with the laws of the United Mexican States. Any controversy, dispute, or claim arising out of or relating to these terms, the purchase, or the use of the Software shall be submitted to the exclusive jurisdiction of the competent courts in Mexico, with the Customer waiving any other jurisdiction that might correspond to them by reason of their current or future domicile.
